Terms and Conditions
Welcome to North County Excavation. By hiring or working with us, you agree to the following terms and conditions. These terms outline the responsibilities of both the client (you) and the operator (North County Excavation, owned and operated by Anthony Beckett).
1. Services
North County Excavation provides professional excavation services, including but not limited to site preparation, grading, trenching, and related earthmoving work. All work will be performed as outlined in the agreed-upon project scope or waiver signed prior to the start of work.
2. Waiver and Liability
Before work begins, a waiver will be provided outlining responsibilities and expectations for both parties.
It is the client’s responsibility to contact 811 Dig Alert to identify underground utilities (gas, electric, sewer, cable, water lines, irrigation, etc.) prior to excavation.
Failure to do so waives liability from North County Excavation for any damage that may occur to unmarked utilities or underground structures.
The client acknowledges that the excavator weighs approximately 1.8 tons, and North County Excavation is not responsible for any damage that may occur to:
Concrete slabs (including cracks or stress fractures)
Grass, lawns, or landscaping due to machine movement or access
Pre-existing site conditions or hidden underground materials
If accidental damage occurs to structures such as a wall, fence, or home, that responsibility will be accepted by North County Excavation and rectified appropriately.
3. Site Access
The client must ensure adequate access for the equipment:
Minimum access width: 3 feet 3 inches
Minimum clearance height: 7 feet from the ground
Failure to provide suitable access may result in rescheduling or additional fees.
4. Material Handling and Disposal
Unless otherwise arranged, all soil, debris, or materials excavated during the project remain the responsibility of the client.
If the client wishes for North County Excavation to remove or haul away materials, this must be discussed and agreed upon in advance and may incur additional charges.
5. Machine Rental Terms
North County Excavation offers the option to rent the excavator for personal or contractor use.
A $250 deposit is required before renting the machine.
Free delivery within 5 miles of la costa, Carlsbad if further then a gas charge may apply.
Any damages to the equipment during the rental period will be charged to the renter based on the cost of repairs.
If damages exceed $250, full payment for the repair amount is expected within 7 days of the rental’s end date.
When the machine is rented, all liability is waived from North County Excavation. The renter assumes full responsibility for:
Any damages or loss of the machine
Personal injuries or property damage occurring during use
Renters are required to have adequate insurance coverage for any potential damages or injuries.
Before renting, renters must have sufficient training and understanding of the machine’s operation.
By proceeding with a rental, the renter acknowledges these conditions and accepts full responsibility for the safe and proper use of the equipment.
6. Contractors and Individuals
These same terms and conditions apply to individual clients as well as contractors hiring North County Excavation for subcontracted work.
7. Payments and Scheduling
Payment terms, including deposits, completion payments, or hourly rates, will be discussed prior to starting work. Work will not begin until the client has signed the waiver and agreed to the project scope.
8. Safety and Responsibility
North County Excavation adheres to all required safety protocols and operates with care to protect property and people on-site. Clients are responsible for ensuring pets, children, and bystanders are kept away from the work area at all times.
